Hanson <br />Municipalities that enforce the State Building Code are required to update their building code <br />ordinance to reflect the new building code in order to enforce it properly. Minnesota statute <br />16B.62 states; "All municipalities shall adopt and enforce the state building code with respect to <br />new construction within their respective jurisdictions ". <br />I have enclosed two copies of sample ordinances that have been drafted by the Minnesota <br />Department of Administration, Building Codes and Standards Division for review. <br />The ordinance titled "sample ordinance" is formatted similar to the City of Little Canada's <br />Municipal Ordinance number 301.010. It identifies each specific section of the code being <br />adopted and optional rules and appendix chapters. The advantage of this ordinance is that it <br />clearly identifies for the public what the State Building Code is. The disadvantage is that the <br />code is amended from time to time and the ordinance would have to be redone. <br />The ordinance titled "sample ordinance, self perpetuating" is an abbreviated version of the <br />"sample ordinance" and is intended to always reflect the most current edition of the State <br />Building Code. The advantage of the self- perpetuating ordinance is that as the code is updated it <br />does not need to be readopted unless there is a change in the optional provisions or the fee <br />schedule is changed. <br />The optional provisions mentioned in both ordinances refer to Minnesota Rules Chapter 1306, <br />Special Fire Protection Systems, Chapter 1335, Floodproofing Regulations, parts 1335.0600 to <br />1335.1200 and Appendix Chapter K (Grading), of the 2001 Supplements to the International <br />Building Code. <br />1.
