shall be prima facie evidence that intoxicating liquor is being peuuitted to be consumed or displayed <br />contrary to this ordinance. <br />(8) Any peace officer may enter, inspect and search the premises of the licensee during <br />business hours without a search and seizure warrant and may seize all intoxicating liquor found on <br />the licensed premises in violation of Subdivision 7. The licensee shall permit police officers, fire <br />inspectors, and other agents of the City to inspect and examine the place of business. The refusal <br />on the part of an applicant or licensee to peunit such inspection shall be sufficient for denial, <br />revocation or suspension of the license. <br />(9) There shall be no dancing, exhibitions or entertainment on the premises of a 3.2 <br />percent malt liquor licensee unless said licensee holds a "Dancing and Entertainment" license, or the <br />premises are covered by a temporary "on- sale" license. <br />(10) No 3.2 percent malt liquor licensee shall allow music on the premises between the <br />hours of 9:00 o'clock p.m. and 9:00 o'clock a.m., except where the licensee has obtained a "Dancing <br />and Entertainment" license, or the premises are covered by a temporary "on- sale" license. Such <br />licensee shall, however, be peiniitted to operate a radio or phonograph between the hours of 9:00 <br />o'clock p.m. and 9:00 o'clock a.m., so long as said radio or phonograph is not an annoyance to <br />occupants of nearby premises, and does not violate local ordinances and State law defining excessive <br />noise as a public nuisance. <br />(11) No 3.2 percent malt liquor licensee shall keep, possess or operate or peunit the <br />keeping, possession or operation of, on any licensed premises, or in any room adjoining the licensed <br />premises, any slot machine, dice, blackjack table, or any gambling device or apparatus, whether or <br />not said devices are being used in violation of M.S. 609.755 or 609.76. A blackjack table which is <br />not being used in violation of M.S. 609.755 or 609.76 shall be exempt from this prohibition. No <br />licensee shall permit any gambling on the licensed premises. This Section shall not preclude lawful <br />gambling pursuant to M.S. 349 nor shall it preclude the possession of properly licensed and <br />registered gambling equipment as defined in M.S. 349.12, Subd. 15. No licensee shall permit the <br />licensed premises or any room therein or any room in any adjoining building, directly or indirectly <br />under his control, to be used as a resort for prostitutes or other disorderly persons. <br />702.080. VIOLATION BY AGENT. Every licensee is responsible for the conduct in <br />the licensed establishment and any sale of alcoholic beverages by any employee authorized to sell <br />such beverages is the act of the licensee. <br />702.090. HOURS OF SALE. No 3.2 percent malt liquor shall be sold between the <br />hours of 1:00 o'clock a.m. and 8:00 o'clock a.m. on the days of Monday through Saturday, nor <br />between 1:00 o'clock a.m. and 10:00 o'clock a.m. on Sundays. No "on- sale" licensee shall permit <br />the consumption of 3.2 percent malt liquor during the hours when sale is prohibited, except that the <br />licensee shall be allowed a 30- minute period following closing to clear the premises. Any customer <br />purchasing 3.2 percent malt liquor prior to 1:00 o'clock a.m., may consume such beverage on the <br />702 -5 <br />
