6. Standards: THE CITY shall furnish THE ENGINEER with a copy of <br />any design and construction standards they may require in the <br />preparation of contract documents for the Project. <br />7. Owner's Representative: The City Administrator of THE CITY of <br />Little Canada shall act as THE CITY's representative with respect to <br />the work to be performed under this Agreement. The City <br />Administrator shall have complete authority to transmit instructions, <br />receive information, interpret and define City's policy and decisions, <br />with respect the materials, equipment, elements, and systems <br />pertinent to the work covered by the this Agreement. <br />Section V. The City's Compensation to the Engineer for Project Related Services. <br />1. Projects: <br />a. Progress Payments: Within thirty days of invoicing by THE <br />ENGINEER, THE CITY shall pay THE ENGINEER for <br />professional services performed under Section II of this <br />agreement in proportion to services performed during the <br />period. THE ENGINEER shall furnish to THE CITY payroll <br />data including name of individual, hours worked, and hourly <br />rate of pay broken down for each project. <br />b. Payments Withheld from Contractors: No deduction shall <br />be made from THE ENGINEER's compensation on account of <br />penalty, liquidated damages, or other amounts withheld from <br />payments to the Contractor. <br />c. Abandoned or Suspended Work: If any work performed by <br />THE ENGINEER is abandoned or suspended in whole or in <br />part, THE ENGINEER shall be paid for any services performed <br />on account of it prior to receipt of written notice from THE <br />CITY of such abandonment or suspension, together with any <br />terminal expenses resulting therefrom, all as shown on <br />Schedule B attached hereto and incorporated herein by <br />reference. <br />d. Basic Services of the Engineer: THE CITY shall pay THE <br />ENGINEER for the basic project services described in Section <br />H of this Agreement up to a maximum fee as depicted on <br />Schedule A based on a percentage of the total construction <br />cost. Progress payments made up to the maximum shall be <br />based upon the hourly rates provided in Schedule B. <br />2. Payment for Additional Services of the Engineer: For additional <br />services defined in Section 1L3 THE CITY shall pay THE ENGINEER <br />on an hourly salary basis as noted on the attached Schedule B. <br />9 <br />
