MINUTES PLANiNING COMMISSION AUGUST 12, 2004 Molloy reviewed the restaurant floor plan indicating his plans to expand restroom facilities at the billiard hall and also pointing out that there are currently two separate billiard areas that are separated by a half wall. After considerable discussion relative to monitoring alcohol sales and controlling alcohol consumption, the Commission and Melloy agreed that alcohol sales and consumption would be limited to the back billiard area. Mellow indicated that he would likely use a portable bar in this area that would be locked down and put away. Melloy indicated he would be requesting a 2 a.m. liquor license, but would plan to have last call at 1 a.m. with the bar locked down and put away after that. It was noted that Coliseum has a closing time of 4 a.m. Molloy indicated that he would plan to raise the height of the half wall to a minimum of 6 feet so that beer could not be passed over the wall to under aged customers. The entrance to and from the back "21 and over" portion of the billiard hall would be monitored and controlled. Duray stated that given he owns and operates a competing business in the City, he would refrain from discussing and voting on this matter. Barraclough noted that Melloy had demonstrated due diligence in running his business, and felt that the request under the conditions discussed was acceptable. Rheaume agreed and stated that he supported the separation of the two areas, one area for the 21 and over crowd where beer would be served, and the other where there would be no alcohol sales or consumption. Barraclough recommended approval of the Amendment to Conditional Use Permit to allow alcohol sales as part of the Coliseum Billiard operation at 2900 Rice Street as requested by Mike Melloy subject to compliance with the recommendations of the City Planner, and subject to the separation of the billiard areas as discussed by a minimum height wall of 6 feet with the entrance into the billiard area where alcohol is to be served and consumed to be monitored and secured. Motion seconded by Wojcik Motion carried 5 — 0. Duray abstained. VARIANCE- Beverly i- Iotfman, Round Lake Trail Townhome Association, appeared FROM before the Commission requesting approval of a Variance from the SIIORELAND Shoreland District setback requirement to allow the replacement and SETBACK — extension of a retaining wall. Hoffman reported that the existing wall ROUND LAIQ? in front of two of the townhome buildings is rotting and needs
