TWENTY -SIXTH RIDER TO AGREEMENT THIS AGREEMENT, made this 4th day of June, 2004, by and between the BOARD OF WATER COMMISSIOiNERS OF THE CITY OF SAINT PAUL ("Board"), and the CITY OF LITTLE CANADA, County of Ramsey, State of Minnesota, ("City"), being the Twenty -Sixth Rider to that certain Agreement made by and between the Board and the City the 13th day of July, 1966, and by this reference incorporated herein and made part hereof and with the same intent, purpose and effect as if said Agreement were set forth herein verbatim. WHEREAS, the Board is owner of a one - hundred and seventy -foot (170') wide right -of -way located in the SW quarter of Section 31, Township 30 North, Range 22 West, Ramsey County, Minnesota, from Twin Lake Boulevard to Country Drive, under I -694 in the City of Little Canada, collectively the "Premises' ; and WHEREAS, the City desires to enter upon certain portions of said Premises to construct a eight -inch (8") water main, within a steel casing tube; and WHEREAS, the Board is willing to grant said permission to the City consistent with the requirements and safety of the works of the Board. NOW, THEREFORE, BE IT AGREED, in consideration of the mutual promises and agreements of the parties hereto, that subject to all teens and conditions contained in said Agreement between the parties hereto made and entered into the 13th day of July 1966. the Board hereby grants to the City permission to enter upon portions of said Premises and to there within install, maintain and carry out all Board approved operations in respect to the following and as indicated in Exhibit attached hereto and incorporated herein by reference: -2- Nr9 rum LutfluC. tioARDA4GRLrA9E :.6 U4 Do
