Hanson <br />Pursuant to our discussion today, I have again reviewed the zoning code relative to your proposed <br />establishment of a business at 2526 Rice Street. Based upon your past representations and our <br />discussion today, I believe a summary of this situation can best be defined as follows: <br />• You have most recently represented that projected sales are based on the folio <br />1. Reloading equipment, dies, and components — 40% <br />2. Gun ammo, accessories, and cleaning gear — 15% <br />3. Gun sales of all types (new, used, & consignment) — 15% <br />4. Tobacco products & accessories — 15% <br />5. Gun safety classes & certification — 10% <br />6. Wildlife Art Work — 5% <br />• You have emphasized that the reloading portion of your business is in effect the primary use. <br />• The B -3 zoning code, a copy of which has been provided to you previously, does not indicate <br />that "reloading equipment, dies, and components is a permitted use in the B -3 district. <br />• The combination of reloading, ammo, accessories, and gun sales makes up 70% of your <br />business. <br />• The floor plan layout you previously submitted depicts a substantial area devoted to the <br />display of guns and accessories. (copy attached) <br />• Little Canada Zoning Code Section 901.080 states as follows: Whenever in any zoning <br />district a use is neither specifically permitted or denied, the use shall be considered <br />prohibited. In such case, the City Council or the Planning Commission, on their own <br />initiative or upon request, may conduct a study to determine if the use is acceptable and <br />if so what zoning district would be most appropriate and the determination as to <br />conditions and standards relating to development of the use. The City Council, Planning <br />Commission or property owner, upon receipt of the staff study shall, if appropriate, <br />initiate an amendment to the Zoning Ordinance to provide for the particular use under <br />consideration or shall find that the use is not compatible for development within the City. <br />
