MINUTES
CITY COUNCIL
JULY 14, 2004
CONSENT
AGENDA
under the City's Code. The Administrator reported that if used guns are
being sold, however, a second hand goods dealer's license would be
required. The Administrator indicated that at the point he became aware
of Mr. Kennedy's intentions, the City informed him that gun stores were
not permitted as a principal use.
Blesener noted that if the Code is amended to allow gun shops, the City
must establish the proper guidelines and controls to protect the residents of
Little Canada as there will be additional requests for gun shops.
Hendricks asked if Mr. Kennedy could open his gun shop up on a
temporary basis until his lease is up.
Fahey replied that gun shops are not a permitted principal use; therefore,
the store could not be opened under a temporary situation. Fahey again
indicated his support for a zoning study to determine what other cities are
doing as well as to obtain input from the Sheriffs Department. Fahey
indicated that he does not have enough information this evening to make a
decision. Fahey suggested that the matter be brought back to the July 28th
meeting.
Anderson asked if Mr. Kennedy was able to operate the store in the
meantime without gun sales. Kennedy indicated that it would be a
hardship to do so, and reported that the gun sales are a lure to get people
into the store for his other products.
The City Administrator noted that he has reviewed Mr. Kennedy's lease
which has a clause that would allow Kennedy to break the lease if he were
not able to obtain City approval.
Fahey stated that he was not willing to make a policy decision based on
M.r. Kennedy's economic circumstances. Fahey again stated that the
matter would be scheduled for review at the July 28t 1 Council meeting
pending a zoning use study and input from the Sheriffs Department.
Council agreed.
Mr. LaValle introduced the following resolution and moved its adoption:
RESOLUTION NO 2004 -7 -142 — APPROVING THE CONSENT
AGENDA WHICH CONTAINS THE FOLLOWING:
* APPROVAL OF THE VOUCHERS:
*APPROVAL OF THE RENEWAL OF AUTO SALES LICENSES AS
RECOMMENDED 131' CITY ST, t FF;
