Hidden Acres <br />Development Contract <br />33. This agreement shall be binding upon the parties, their heirs, successors or <br />assigns, as the case may be. <br />34. Developer may obtain up to three (3) building permits for lots within the Hidden <br />Acres plat prior to the completion of the required improvements. However, Developer <br />acknowledges that City will not issue any certificates of occupancy for these structures until the <br />first lift of asphalt is installed on the street surfaces and other improvements have been <br />substantially completed and approved by the City. <br />35. Developer shall cooperate fully with the City in the implementation of a tax <br />abatement program to ensure the recovery of all costs associated with the acquisition of sixteen <br />(16) feet of additional right -of -way for Nadeau Road from 2883 Condit and seventeen (17) feet <br />of right-of-way for Condit Street. Said cooperation may require the Developer to advance all <br />necessary funds as determined by the City with the understanding that the City is to repay any <br />such advancement plus agreed upon accrued interest from tax abatement funds. The final <br />determination of same shall be made at the City's sole discretion and subject to the execution of <br />any necessary agreements between the City and Developer delineating the terms of any such <br />arrangement. <br />Notices <br />36.
