MINUTES
PLANNING COMMISSION
DECEMBER 9, 2004
Duray asked about the Watershed's recommendations for this plat.
Whitcomb reported that the Final Plat fully complies with all ofthe
recommendations ofthe Watershed District.
Barraclough noted there was neighborhood concern about drainage at
Greenbrier Circle and County Road B -2. Whitcomb indicated that the
City is aware there is a problem with the volume of water coming down
County Road 13-2, but is not willing to pay for resolving the problem at
this time. The ponding provided as part of the Gervais Hills plat will treat
about 80% of the water under the worst case scenario. Whitcomb noted
that the added ponding in the Gervais Hills plat will not totally resolve the
County Road 13-2 drainage problems.
The City Planner indicated that he received a letter from MN DOT today
relative to the Gervais Hills plat. MN DOT has some issues related to the
permit for construction within their ditch right -of -way. They are asking
that construction be stopped until they have a chance to review
construction plans as that construction relates to their ditch easement. The
Planner noted that this issue does not relate to the layout of the Final Plat.
If the Commission is inclined to approve the Final Plat, the Planner
recommended that approval be subject to resolution of the MN DOT
issues.
Whitcomb indicated that they have had difficulty in determining the
appropriate contact person at MN DOT in order to address the issues
raised in their letter. Whitcomb indicated that they are now in the process
of working with MN' DOT to resolve the matter. Whitcomb noted that
only one of the proposed lots is encumbered by the MN DOT right -of-
way, and he is aware that this issue will have to be resolved before that lot
can be sold.
Knudsen pointed out that the City Engineer's letter indicates the developer
has accommodated the City's ponding request "to the extent possible ".
Knudsen pointed out there is clear acknowledgement of a drainage
problem in the area. He stated that he did not feel it acceptable to
accommodate additional ponding "to the extent possible" without reducing
the number of lots.
Knudsen is concerned about the following considering the breakneck pace
of grading ofthe property since mid November:
the only time the Commission has heard about the Watershed's
requirements is second hand and mostly from the developer himself;
the developer's claim that he called some guy at MNDOT and it wasn't his
fault that he didn't have the necessary permitting;
3
