CITY OF LITTLE CANADA <br />RESOLUTION VACATING PEDESTRIAN TRAIL EASEMENT <br />WHEREAS, <br />A majority of the owners of property abutting certain pedestrian trail easement described <br />below have requested the City Council in a petition dated November 18, 2004 to vacate <br />such pedestrian trail easement according to the law; <br />AND WHEREAS, <br />A public hearing was held on December 15, 2004 before the City Council in the City <br />Center on such petition after due published and posted notice had been given by the City <br />Administrator, a reasonable attempt was made to give personal notice to all affected <br />property owners, and all persons interested were given an opportunity to be heard; <br />AND WHEREAS, <br />Any person, corporation, or city owning or controlling easements contained upon the <br />property vacated, reserves the right to continue maintaining the same or to enter upon <br />such way or portion thereof vacated to maintain, repair, replace, remove, store or <br />otherwise attend thereto; <br />AND WHEREAS, <br />It appears that it will be in the best interest of the City to approve such petition; <br />NOW, THEREFORE, BE IT RESOLVED, that such petition is hereby granted and the <br />pedestrian trail easement described as follows is hereby vacated: <br />-4- <br />
