convicted of a crime other than a violation of this Chapter, or violations of State or local gambling <br />taws. <br />(5) Not more than one (1) retailers license shall be directly or indirectly issued to any one <br />person or for any one place in the City, nor shall any retailers "on- sale" or "off- sale" license be <br />directly or indirectly issued for any place for which a license of another class has been granted. <br />(6) No more than one license shall be issued to any person in the municipality. <br />(7) No retail license to sell alcoholic beverages maybe issued or renewed to a club which <br />discriminates against members or applicants for membership or guests of members on the basis of <br />race. <br />703.130. VIOLATION BY AGENT. Every licensee is responsible for the conduct and <br />the licensed establishment and any sale of alcoholic beverage by any employee authorized to sell <br />such beverage is the act of the licensee. <br />703.140. OPERATION HOURS. <br />(1) Except as provided in Subpart (4) herein, no "on- sale" sale of liquor shall be made <br />after one o'clock a.m. on Sunday, nor until eight o'clock a.m. on Monday, except as provided herein. <br />No such "on- sale" shall be made on Tuesday, Wednesday, Thursday, Friday or Saturday, between the <br />hours of one o'clock a.m. and eight o'clock a.m. On Sunday, no such "on- sale" sale shall be made <br />except between the hours of ten o'clock a.m. and one o'clock a.m. on Monday. <br />(2) No "off- sale" sales of such liquor shall be made before 8:00 a.m. or after 8:00 p.m. on <br />Monday, Tuesday, Wednesday and Thursday, and before the hour of 8:00 a.m., or after the hour of <br />10:00 p.m. on Friday and Saturday, and no such "off- sale" sales of liquor shall be made at any time <br />on Sunday. No "off- sale" sales shall be made on Thanksgiving Day or on Christmas Day, December <br />25, or after 8:00 p.m. on Christmas Eve, December 24. "Off'sale" sales may be made until 10:00 <br />p.m. on December 31 and July 3, and on the day preceding Thanksgiving Day, unless these days are <br />a Sunday. <br />(3) Except as provided in Subpart (4) herein, no "on- sale" license shall permit the <br />consumption of intoxicating liquor on the premises during the hours when sale is prohibited, except <br />that the licensee shall be allowed a thirty minute period following closing to clear the premises. Any <br />customer purchasing intoxicating liquor prior to 1:00 o'clock a.m. may consume such beverage on <br />the premises until 1:30 o'clock a.m. Under no circumstances shall any individuals, whether or not <br />customers, other than the owners or employees of the licensee, be allowed to remain on the premises <br />after 1:30 o'clock a.m. <br />(4) With respect to a licensee who has obtained an on -sale 2:00 a.m. intoxicating liquor <br />license, no "on- sale" sale of liquor shall be made after two o'clock a.m. on Sunday, nor until eight o- <br />703 -8 <br />
