MINUTES
PLANNING COMMISSION
SEPTEMBER 9, 2004
CONDITIONAL
USE PERMIT —
3091 ARCADE
STREET —
JIM DALY
PROPERTY
DIVISION —
469 LABORS
ROAD —
GREG STARK
Jim Daly, 3091 Arcade Street, appeared before the Commission
requesting approval ofa second garage on a property as well as total
garage space over 1,000 square feet. Daly indicated that he currently
has a single -car garage and does not have enough room to expand his
garage to the north. Daly pointed out that his lot is heavily wooded, and
he would like to place the new garage in the woods. Therefore, rather than
side the garage white to match the house, he would prefer to have cedar
siding that would blend into the woods. Daly noted the petition he
submitted from his neighbors stating their preference for the cedar siding.
Daly noted that the City Planner recommended shrubs and trees be planted
to delineate the northern property line. Daly introduced his neighbor,
Rosie Degnan, and reported that Ms. Degnan utilizes his driveway for
access to a well in the back of her property. The planting of trees and
shrubs would interfere with maintenance access to this well.
Duray asked if the request met Code requirements. The City Planner
replied that it did, and noted that the Daly property is very large.
Barraclough asked if the setback for the driveway met Code requirements.
The City Planner indicated that five feet is a typical setback for a
driveway. It appears that there is enough room to meet a five -foot
setback. The Planner indicated that his continents relative to plantings
along the driveway made the assumption that this is what the neighbor
would prefer. Obviously, that is not the case.
Duray recommended approval of the Conditional Use Permit to allow a
second garage on a property as well as total garage space over 1,000
square feet for 3091 Arcade Street as requested by Jim and Lisa Daly,
subject to the detached garage not exceeding 15 feet in height and subject
to there being no commercial or home occupation activities on the
property.
Motion seconded by Weihe.
Motion carried 6 — 0.
Greg Stark appeared before the Commission requesting the division of
469 LaBore Road into three single - family lots. Stark indicated that all
three lots exceed the City's minimum requirements. Stark reported that
he is still in the process of purchasing the property. The property is an
estate, and there are some title issues that should be resolved within the
next couple of weeks. Stark reported that once the closing occurs, he has
- 4 -
