ceaznacher
515 Little Canada Road, Little Canada, MN 55117 -1600
(651) 766 -4029 / FAX: (651) 766 -4048
www, ci.little- canada. mn. us
MEMORANDUM
TO: Mayor Fahey and Members of the City Council
FROM: Joel Hanson, City Administrator
DATE: September 20, 2002
RE: Pipeline Ordinance
MAYOR
Michael I. Fahey
COUNCIL
Beverly Scalze
Jim LaValle
Matt Anderson
Rick Montour
ADMINISTRATOR
Joel R. Hanson
Staff has conducted research on the issue of a pipeline ordinance. Here is a summary of what we
discovered.
• The only Minnesota city that we found thus far which has a pipeline setback ordinance is
Maplewood. We have contacted Maplewood relative to their enforcement of this ordinance
and have attached their comments.
• The City of Woodbury has a "policy" regarding pipeline setbacks. They require a 50 -foot
setback from the edge of the easement. Given the policy format, we are not sure how
enforceable it is should it be challenged. The City Attorney should comment on this option.
• Mr. Charles Kenow from the Office of Pipeline Safety was not able to garner us any
additional information regarding Minnesota Cities and pipeline setback ordinances. He did
forward to us the California Law dealing with setbacks. (A copy is attached.) This seems
similar to the Minnesota Law.
• We reviewed the pipeline maps for our City and attempted to scale the approximate
structure setbacks from these documents. A chart of setback ranges from both the Williams
and Amoco lines is below. It should be noted that this listing includes commercial and
multi - family structures as well as single - family. Also attached are maps showing the
pipelines and the impacts on individual properties.
Williams Pipeline Amoco Pipeline
Oto25feet 5 3
26 to 50 feet 17 6
51 to 75 feet 7 10
76 to 100 feet 13 17
101 to 125 feet 16 35
126 to 150 feet 16 14
Greater than 150 feet 39 20
