MINUTES CITY COUNCIL NOVEMBER 20, 2002 The City Administrator noted that the rezoning to PUD can be processed in the December meeting cycle. Mr. Johnson was unsure as to the impact of the PUD zoning versus I -1 zoning. Fahey noted that the PUD zoning will allow Mr. Johnson to utilize the property as has been discussed. However, any future owners of the property with uses different than Mr. Johnson's will have to obtain City Council approval for their use. Fahey noted that the City has had significant enforcement problems relative to outdoor storage uses. Therefore, the Council wants to ensure that the City has the control it needs to avoid problems in the future. Fahey noted that the plat as proposed is acceptable, and the Council is agreeable to the third canopy remaining in place provided that a stucco finish is added. The City Administrator noted that a lcey issue is completion of the development agreement between the City and Mr. Johnson. The development agreement can be processed during the December meeting cycle along with the rezoning to PUD. There was no one present from the general public wishing to comment on this matter. Upon motion by Fahey, seconded by Scalze, the public hearing was closed. Fahey introduced the following resolution and moved its adoption: RESOLUTION NO. 2002 -7I -276 - GRANTING CONCEPT APPROVAL TO THE DRYWALL SUPPY ADDITION AS PROPOSED SUBJECT TO EXECUTION OFA DEVELOPMENT AGREEMENT BETWEEN MR. JOHNSON AND THE CITY, AND CALLING FOR A PUBLIC HEARING TO CONSIDER THE REZONING OF THE ENTIRE PARCEL FROM BUSINESS- WAREHOUSE (B -WW) TO PLANNED UNIT DEVELOPMENT (PUD) The foregoing resolution was duly seconded by Scalze. Ayes (4) Fahey, Scalze, Montour, Anderson. Nays (0). Resolution declared adopted.
