Hanson <br />Sherman Associates has asked for a right of entry to allow them to grade and stockpile material on the <br />Cardinal and Rutzick properties. Should the townhome portion of the project go forward, this material is <br />needed to balance the site from a grading perspective. <br />Attached is the proposed agreement. At the writing of this memo, I have not yet had a chance to review <br />it. The main issue we were still addressing involves the restoration of the site should the townhome <br />project not proceed and we have to find another developer. While I do not feel this is a likely outcome, <br />we need to ensure the City is not left with a site that detracts from this area. <br />Subject to final reviews by the City Attorney and me, I will be recommending approval of this agreement <br />at Tuesday's meeting in essentially this form. Should there be any issues that cause you concern, please <br />let me know as soon as possible and I will attempt to resolve them by Tuesday's meeting. <br />
