Hanson <br />RE: Accept Quit Claim Deed for Excess Highway Right -Of -Way <br />Call for Vacation Hearing for both Right -Of -Way as well as a Portion of Rose <br />Lane <br />As you may recall, the Council approved a setback variance for Mr. Sam Roberto in March of 2002 <br />to allow the development of the property at the northwest corner of Rose Lane and Savage Lane <br />given the existing wetland in this area. Another factor in the development of this property was the <br />fact that MN DOT was in the process of conveying excess highway right -of -way to the City. Mr. <br />Roberto had also applied for Vacation of a portion of the excess right -of -way as well as a portion of <br />Rose Lane as it abuts his property (see map attached). As you will recall, in previous discussions on <br />this issue, there may be interest from property owners on the south side of Rose Lane in gaining a <br />portion of the right -of -way. Therefore, the public hearing notice for the vacation will be drafted in <br />such a manner as to leave this option open for Council consideration. <br />Attached is a Quit Claim Deed conveying excess highway right -of -way to the City. I would <br />recommend acceptance of this Deed as presented. <br />I would further recommend that the Council call for a Public Hearing to consider the vacation of a <br />portion of this right -of -way as well as 10 feet of Rose Lane as it abuts the Roberto property. This <br />public hearing should be scheduled for Wednesday, January 22, 2003, at 7:30 p.m. <br />
