Hanson <br />www.ci.little-canada.mn.us <br />MEMORANDUM <br />TO: Mayor Fahey & Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: November 8, 2002 <br />RE: Withholding Deposit — JR's Powerhouse Gym <br />The new manager of JR's gym, Jodi, called me at the beginning of October requesting more information <br />as to the $200.00 dollar check we cashed back in mid March 2002. I explained to her that JR's was in <br />violation of their temporary permit #1 -02. The permit expiration date was March 11, 2002 and it was not <br />removed until the end of the day on March 12, 2002. On March 12 I called Staci to notify her that JR's <br />would not be refunded their deposit because of this violation. I thoroughly explained the new ordinance <br />change for 2002 and the deposit guidelines to Staci when she took out the permit. <br />Based upon this information, the new manager of JR's is requesting that we refund the deposit. I have <br />attached copies of both JR's letter and Dollar Signs' letter to the City that explains their position <br />regarding this request. As you will recall, this deposit requirement was enacted by the City Council last <br />year (copy attached). The deposit was established at $200.00 (see minutes attached). The goal of this <br />revision was to ensure compliance with our ordinance, including the timely removal of temporary signs. <br />If the Council feels the ordinance is appropriate, then staff would recommend we not refund this deposit. <br />While sympathizing with JR's regarding the impact this fee can have on a small business, future <br />application of this provision to other permittees would become difficult if the precedent is established by <br />granting an exemption in this instance. If the Council feels an adjustment is warranted, then staff would <br />recommend you revise the deposit retroactively to an amount you feel is appropriate in this instance and <br />future occurrences. <br />cc: JR's Powerhouse Gym <br />Dollar Signs' <br />
