515 Little Canada Road, Little Canada, MN 55117 -1600
(651) 766 -4029 / FAX: (651) 766 -4048
www. ci.little- canada. mn. us
MEMORANDUM
TO: Mayor Fahey and Members of the City Council
FROM: Joel R. Hanson, City Administrator
DATE: November 8, 2002
RE: Request for Organized Collection Exemption
Daniel and Valerie Byrne — 75 West Demont Avenue
MAYOR
Michael I. Fahey
COUNCIL
Beverly Scalze
Jim LaValle
Matt Anderson
Rick Montour
ADMINISTRATOR
Joel R. Hanson
Daniel and Valerie Byrne have requested an exemption from the City's Organized Collection
Ordinance. They are residents of the City and had owned a business within Little Canada. At the
time their business was located in Little Canada, the Byrne's had an organized collection exemption
for their residence. Now that the business is located outside of the City, the Organized Collection
Ordinance requires that service must be provided at their residence.
There are other residents of the City who own and operate businesses outside of Little Canada, and
the Council may recall that it has been faced with similar requests for exemptions under these
circumstances. However, the Council has not granted any of these requests and has enforced the
ordinance. It should be noted that other cities have similar provisions requiring that residents have
refuse service at their homes even if they own businesses located in another city and are paying for
service at that location.
It would be staffs recommendation to deny the request for exemption made by Mr. and Mrs. Byrne.
cc: Daniel and Valerie Byrne
