EMPLOYMENT AGREEMENT THIS AGREEMENT, made and entered this 13th day of November, 2002, by and between the City of Little Canada, a Municipal Corporation under the laws of the State of Minnesota, hereinafter referred to as "City ", and Stephen Westerhaus, hereinafter referred to as "Westerhaus ". WITNESSETH: WHEREAS, City desires to employ Westerhaus as its Building Official, effective, January 1, 2002; and WHEREAS, Westerhaus agrees to enter the employment of the City of Little Canada on that date; and WHEREAS, both parties desire to establish the terms of this employment; IT IS HEREBY AGREED AS FOLLOWS: 1. POSITION. City agrees to employ Westerhaus as its Building Official pursuant to the job description attached as Exhibit A and the Agreement between the cities of Falcon Heights and Little Canada attached as Exhibit B. Westerhaus agrees to serve as the Building Official for City, will devote his full business time and best efforts to the City, and will engage in no outside business without the prior approval of City. Westerhaus agrees to perform the duties of Building Official as they have been explained to him and as they may be changed from time to tune. Additionally, Westerhaus shall be required to perform such other duties as may be directed from time to time. 2. LICENSURE. Westerhaus agrees to maintain current licensure issued by the State of Minnesota as a Building Official. Evidence of licensure shall be provided to City upon execution of this agreement. Should licensure of Westerhaus have any change in status that impacts Westerhaus' ability to provide the services contemplated by this agreement, Westerhaus shall give immediate notice to City. It is further understood that Westerhaus shall provide all such duties as a Building Official to ensure the needs of the City are fully met, including appropriate plan reviews of all permit applications. Furthermore, Westerhaus shall also maintain the appropriate credentials to serve as a fire marshal.
