The site is zoned I -P, Industrial Park, which limits <br />outdoor storage to 75% of the principal building size by Conditional Use Permit. The zoning <br />ordinance prohibits these types of accessory uses in the required yard areas, that is, the uses <br />must meet the setbacks of the zoning district. In this case, the proposed storage area was <br />shown to be 40 feet from the Spruce Street right of way, consistent with the required setback <br />from that street. <br />In addition, while we often think of the restrictions on corner lots as applying to two front yards, <br />the reality is that there is only one front yard. One of the "frontages" is actually a side yard, to <br />which the ordinance often applies setbacks that are the same as the front yard. In the case of <br />the Orius building, the front is on Country Drive, and the Spruce Street exposure is a side yard. <br />The required side yard setback on the exposed street side is 40 feet. <br />If the intent of the City Council would be to require that accessory uses (such as the storage <br />area) be located only in the rear yard, the ordinance could be changed to accommodate this <br />intent. A zoning text amendment would need to be processed stating something to the effect <br />that such uses would be restricted to a location that is no nearer the street than the rear <br />building line of the principal building. <br />This item could be placed on an upcoming Planning Commission agenda for further <br />consideration at the direction of the City Council. <br />Pc: Joel Hanson <br />
