MINUTES
CITY COUNCIL
JUNE 26, 2002
REZONING
CONCEPT
REVIEW —
CERTAIN
LITTLE
CANADA ROAD
PROPERTIES
The Council reviewed the concept for rezoning certain properties on
Little Canada Road east of 35E from General Business (B -3) to
Residential Business (R -B). Council noted that the Planning Cornmission
has recommended approval of this concept to rezone.
The City Planner pointed out that the existing 8-3 zoning presents some
difficulties for the residentially used properties.
Scalze noted that the area is a nice residential neighborhood and she felt it
would remain as such. Scalze noted that at one time the thought was that
this area would convert to a commercial strip. However, it does not
appear that this will happen.
LaValle asked what prompted review of this concept. The City Planner
noted that the Youngs /Fuller property was rezoned last year to R -B to
accommodate removal of an existing house and replacement with a new
one. When that application was reviewed, there was some discussion
about looking at the rest of the area given the existing residential uses.
The City Administrator also noted that the Comprehensive Plan comments
on the mix of residential and commercial uses in this area.
Don Smith, property owner in the area, asked what impact the rezoning
will have on his property. Smith noted that he has a business use next
door to him and there have been some problems with parking on this
property.
The City Planner noted that residential uses are permitted uses under the
R -B zoning but are non - conforming uses under B -3 zoning. The Planner
also noted that business uses will require a Conditional Use Permit under
the R -B zoning, which allows the City to review proposed business uses
and place conditions on those uses such as screening, fencing, etc.
Existing business uses would be allowed to continue, but would need to
obtain a CUP should they expand or change.
Scalze also noted that the B -3 zoning would allow a more intense business
use than is allowed in the R -B District.
M.ontour felt that the R -B zoning was an added benefit to the residents
given if there is a fire or natural disaster, they would be allowed to rebuild
their homes. Residential uses would not be allowed to re- establish under
the B -3 zoning.
George Rossez, Advent Construction, asked the disadvantages to him in
rezoning to R -B. The Planner indicated that Advent Construction's office
3
