MINUTES <br />CITY COUNCIL <br />JANUARY 30, 2008 <br />McGraw asked about how the position classification points are determined <br />for the Pay Equity Report. The City Administrator pointed out that the <br />City uses the State Job Match listing to classify its various positions and <br />assign point values. The Administrator noted that the original purpose of <br />the report was to ensure equity between male and female dominated <br />positions, however, the actual usage has broadened somewhat. The State <br />uses the information in the report to do modeling to ensure that City's pay <br />structure is equitable. <br />CITY The City Administrator reviewed the Engagement Letter for City Attorney <br />ATTORNEY Services with Kelly & Fawcett for both civil and prosecution services. <br />SERVICE The Administrator noted that this is a five year contract with fixed rates <br />AGREEMENT for the first two years and 3% increases for each of the third, fourth, and <br />fifth years. Prosecution services are at an hourly rate with a $5,000 per <br />month cap and they include forfeitures. The Administrator reported that <br />as a result of the RFP process and the hiring of Kelly & Fawcett, the City <br />will be saving money for legal services. He also pointed out that Kelly & <br />Fawcett is a very good firm and will represent the City well. <br />Blesener asked about the provision in the contract with regard to off site <br />storage of files. The City Attorney explained their procedures for the off <br />site storage and retrieval of files a minimum of three years old. <br />Ms. Allan introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2008-1-24 -APPROVING THE ENGAGEMENT <br />LETTER FOR CITYATTORNEYSERVICES WITH KELLY & <br />FAWCETT AND AUTHORIZING THE MAYOR AND CITY <br />ADMINISTRATOR TO EXECUTE THE AGREEMENT ON BEHALF <br />OF THE CITY <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />TRANSITION The City Administrator reviewed Sweeney, Borer & Sweeney's <br />FEES WITH January 18, 20081etter relative to transition fees during the change <br />SWEENEY, to Kelly & Fawcett as the City Attorney. The Administrator noted <br />BORER & that SBS will continue to represent the City in the Vadnais Heights <br />SWEENEY sewer billing litigation. There will be some additional riā¢ansition for civil <br />work between the two firms. Prosecution services will be taken over by <br />Kelly & Fawcett effective February 1, 2008. <br />
