TO HAVE AND HOLD said Easement unto said Grantee and its assigns. The Grantor <br />hereby warrants the title to the Easement Tract and will defend such title against the lawful claims of <br />all persons. <br />Grantor shall have the right to use and enjoy the surface and subsurface areas of the <br />Easement Tract for all purposes, with the exception of permanent buildings, including but not limited <br />to parking areas, fences, landscaping, driveways, curbs, gutters and other utilities; provided, <br />however, that Grantor shall not exercise such use and enjoyment in a manner that will impair or <br />interfere with the exercise by Grantee of the easement rights granted herein. <br />Grantee expressly agrees to maintain any utilities located within the Easement Tract in good <br />condition and repair, and to exercise its easement rights in a manner that results in minimum <br />interference with Grantor's ownership, possession and use thereof Grantee shall, at its sole cost and <br />expense, promptly restore any surface areas, including all paving and landscaping, disturbed by the <br />exercise by Grantee of the easement lights granted herein. <br />(The balance of this page intentionally left: blank.) <br />- 2 0 - <br />
