MINUTES <br />PLANNING COMMISSION <br />JUNE 13, 2002 <br />CUP TO <br />EXPAND NON- <br />CONFORMING <br />STRUCTURE — <br />355 LITTLE <br />CANADA ROAD — <br />YOUNGS /,FULLER <br />CONCEPT FOR <br />REZONING <br />CERTAIN <br />LITTLE CANADA <br />ROAD <br />PROPERTIES <br />FROM B -3 TO RB <br />the City Planner and that the business use of the property would be a <br />primary use rather than an accessory use. <br />Motion seconded by Wojcik. <br />Motion carried 6 — 0. <br />Goff indicated that he may withdraw his application and reapply utilizing <br />his Dianna Lane property. The City Planner suggested that Mr. Goff meet <br />with him during staff hours next week given that there are some home <br />occupations that are permitted without the need for a Special Use Permit. <br />These can be explored in relation to the Dianna Lane property given its <br />primary use is residential. <br />The City Planner noted that the property at 355 Little Canada Road was <br />recently rezoned from B -3 to R -B in order that the property owner could <br />replace the existing house on the property with a new home. The property <br />owners have now decided that rather than replace the existing house, they <br />would add onto the existing house. The setbacks for the existing house do <br />not meet the minimum Code requirements, therefore, a Conditional Use <br />Permit would be necessary to expand a non - conforming structure. The <br />Planner noted that his only concern with this request is that access to the <br />existing garage is maintained. It was noted that the site plan does not <br />show the location of the driveway. <br />Given that the applicant was not present at the meeting, the Commission <br />decided to delay discussion of this matter until later on the agenda. <br />The City Planner noted that many properties along Little Canada Road <br />east of 35E are zoned General Business (B -3) although they are being <br />used as residential. The Planner noted that when the Comprehensive Plan <br />was first adopted in 1980, the City envisioned that this area would convert <br />to a business area. This has not happened, existing residences have been <br />well maintained and added onto, and it appears that the residential use <br />of this area will likely continue for the long -term. The recent update of <br />the Comp Plan acknowledged the mix of uses in this area and a rezoning <br />from B -3 to RB would be consistent with that Comp Plan update. The <br />rezoning of this property to RB will provide for more flexibility for the <br />property owners, allowing residential properties to be upgraded or <br />replaced while still allowing some business use of the property. While the <br />RB zoning would not allow for an intense business use such as a <br />Walgreens, it would allow small office uses, for example. <br />
