ECONOMIC DEVELOPMENT AUTHORITY OF THE CITY OF LITTLE CANADA RESOLUTION NO. RESOLUTION INITIATING ACQUISITION WHEREAS, the Economic Development Authority of the City of Little Canada has determined that there is a need for acquisition by the Authority of the property located on the south side of Little Canada Road, east of Rice Street, which property contains 4.92 acres, more or less, which property is also known as the Rutzick property, and which property is legally described as follows: The south 1.65' of the North 1.102.83' of the East 208.72' of the West 417.44' of the Northwest '9 of the SW 14 of Section 6, Township 29, Range 22, and all of Lot 4, Block 1, Sherman Oaks Addition according to the plat on file and of record in the Office of the Registrar of Deeds in and for Ramsey County. WHEREAS, it is necessary and in the public interest and will further the Authority's general plan of economic development to acquire fee title to the Rutzick property, and WHEREAS, it may be impossible to acquire said property by purchase or negotiation, and WHEREAS, Minnesota Statutes Chapter 469 and 117 and other authority grant the Economic Development Authority of the City of Little Canada authority to acquire private property for public purposes when necessary, and WHEREAS, said acquisition by the Economic Development Authority of the City of Little Canada shall be subject to and conditioned upon all applicable requirements of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, Uniform Relocation Act Amendments of 1987, and Minnesota Statutes Section 117.52 NOW THEREFORE BE IT RESOLVED by the Board of Commissioners of the Economic Development Authority of the City of Little Canada that the Executive Director of the Authority or his authorized representative is authorized to commence the necessary steps to acquire fee title to said property by purchase, negotiation, and eminent domain.
