MIN UTES <br />CITY COUNCIL <br />FEBRUARY 27, 2002 <br />AMENDMENT' <br />TO ZONING <br />CODE — <br />B-W DISTRICTS <br />Cindy Mentes noted that it seems that two of the Planning Commission <br />members viewed their property, and in her opinion, once they looked at the <br />area, they changed their minds and supported the CUP. Al Mentes reported <br />that he has talked with his neighbors and no one seems to have a problem with <br />the proposed garage. <br />Mr. Kingstad indicated that the City Planner's report does not take into account <br />the actual conditions of the neighborhood and some of the non - conforming <br />situations that exist. <br />The City Administrator suggested that lithe matter is tabled, it be tabled until <br />the March 27th meeting in order to give the City Attorney an opportunity to <br />prepare his opinion and to allow the City Planner to be present at the <br />discussion. The Administrator also noted that a 60 -day waiver will be required <br />from the applicant. <br />Cindy Mentes agreed that they will submit a 60 -day waiver to delay <br />consideration of this matter until the March 27'x' City Council meeting. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2002-2-37 — TABLING ACTION ON THE <br />APPLICATION FOR CONDITIONAL USE PERMIT FOR 36 FOOT 131' 28 <br />FOOT ACCESSORY GA R4 GE AS REQUESTED 13Y AL AND CINDY <br />MENTES AT 3058 GREENBRIER STREET UNTIL THE MARCH 27, <br />2002 REGULAR COUNCIL MEETING SUBJECT TO THE APPLICANTS <br />SUBMITTING A WRITTEN WAIVER OF THE 60 -DAY REVIEW <br />PERIOD, AND WITHOUT TFJAT WAIVER, THE CITY COUNCIL <br />DEEMS THAT THE CONDITIONAL USE PERMIT APPLICATION IS <br />HEREBY DENIED <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) LaValle, Scalze, Montour, Anderson, Fahey. <br />Nays (0). Resolution declared adopted_ <br />Mayor Fahey opened the Public Hearing to consider an amendment to the <br />Zoning Code relative to the Business - Warehouse (B -W) Zoning District. <br />The Planning Commission has recommended approval of the amendment as <br />presented. <br />Carl Johnson reported that he has a purchase agreement on the Knox property, <br />which would be affected by the proposed change to eliminate outdoor storage <br />in the B -W Zoning District.
