City of Little Canada, Minnesota <br />Ordinance <br />AN ORDINANCE AMENDING SECTION OF THE LITTLE CANADA CITY CODE, <br />BY PROVIDING FOR BUS BENCHES PROVIDED BY PRIVATE COMPANIES. <br />The City Council of the City of Little Canada hereby ordains: <br />Section 1. <br />Section 800 is hereby amended to add the following: <br />8xx.010. Off- Premise Bus Benches. Bus benches may be located by <br />private companies in locations that serve persons waiting <br />for transit vehicles under the following conditions: <br />(A) The bus bench is located at a transit stop as <br />identified by the Metropolitan Council Transit <br />Authority, or other transit authority designated by <br />the City Council. <br />(B) No more than one (1) such bench may be located <br />within three hundred (300) feet of any other bench. <br />(C) The bench may be located within the public right - <br />of -way, upon specific permission of the City <br />Council. <br />(D) No such bench shall interfere with pedestrian <br />traffic or with vehicular traffic visibility. <br />(E) No such bench shall exceed 42 inches in height, 30 <br />inches in depth, and 7 feet in length. <br />(F) The bench owner shall secure permission of any <br />other appropriate authority, including the State or <br />County road jurisdictions where applicable. <br />(G) The owner of the bench shall maintain the bench and <br />the area around the bench, including litter <br />disposal on a schedule approved by the City <br />Council. When necessary, additional maintenance <br />may be required of the bench owner as directed by <br />the Public Works Director. <br />(H) The area under and around the bench shall be paved <br />with a material approved by the City Administrator, <br />and such bench shall be attached to the ground in a <br />manner that deters vandalism. <br />(I) Licenses for bus bench locations shall be issued to <br />qualified applicants on a lottery basis. Such <br />licenses shall be issued on a calendar year basis <br />(January through December). <br />(J) Qualified applicants shall provide proof of <br />insurance, a financial security to cover the City's <br />cost of code enforcement and /or removal, and a <br />"hold- harmless" agreement indemnifying the City <br />
