Hanson <br />April 1, 2002 <br />Page 2 <br />Even if this ordinance would withstand a legal challenge, it does not prohibit the <br />property owners from removing vegetation from the property. In fact, by putting a <br />moratorium on development, it removes the property from regulation by Zoning Code <br />Chapter 903.020 G, which provides limitation on the removal of trees in new <br />developments. Enclosed is a copy of a letter to Cliffton Aichinger requesting that he <br />participate in a determination of the buffer /non - disturbance area. <br />As I informed you via telephone, the Palmen's are willing to wait until after the <br />April 10, 2002 Council meeting before they begin removal of vegetation from their <br />property. <br />The Council must understand that the property in question does not belong to the <br />City or to the outspoken neighbors. If the City wishes to purchase the property they <br />may do so by eminent domain. If they do not wish to purchase the property, we expect <br />them to treat the development of this property in the same reasonable way they have in <br />other developments within the City. <br />Thank you in advance for your responses to my requests. <br />Sincerely, <br />George A.
