Hansom <br />Since securing grant funding for a storm shelter at North Star Estates, I have had difficulty in <br />achieving performance from the owners of the park. It now appears they are ready to move forward <br />with the project. However, I feel we should put a development agreement in place to document the <br />obligations of the park owners to ensure their cooperation to complete this project in a timely fashion. <br />This will also protect us from financial exposure given the fact that we will be incurring costs as the <br />owner of the project to achieve its completion. <br />The key points of this agreement will be as follows: <br />• North Star will apply for a Conditional Use Permit to allow the construction of a s storm <br />shelter within the manufactured home park. <br />• North Star will have to provide a cash deposit of $34,500 as outlined in our grant application. <br />• North Star will have to commit to the transfer of land to the City to facilitate construction of <br />the shelter, including appropriate easements /rights of access. <br />North Star will have to commit to cooperating with the City to secure the common completion <br />of this project. <br />■ North Star will have to enter into a long -term lease for their on -going operation and <br />maintenance of this shelter. <br />It should be noted that the park managers (Tom and Sue Ludden) and the parks' attorney (John <br />Bonner) have been very cooperative in trying to move this project forward. <br />cc: Tom and Sue Ludden <br />Jeff Bonner <br />
