monies deposited pursuant to Exhibit "B" shall be applied to the deposit requirement under Paragraph #11 above. <br />c. The placement of durable iron monuments for marking of platted lots, blocks and boundaries <br />must be set within one year of the recording of the plat. All plat monuments originally set which are removed or <br />disturbed during development shall be replaced after the completion of construction activities or no later than <br />August 1, 2003. All cost incurred with regard to monument placement, verification and replacement shall be borne <br />by the Developer. <br />d. Entrance signage for the development shall be in accordance with City ordinance and <br />architectural requirements. Verification of same shall be made by the Zoning Administrator. <br />e. All storm sewer systems within and serving the development shall be deemed private <br />improvements to be maintained and operated by the property owner, or the governing Association into perpetuity. <br />This responsibility shall be addressed in Association documents. <br />f. Developer, or its agents or assigns, shall promptly clear from public streets and property any <br />soil, earth or debris resulting from construction work done by the Developer or its agents or assigns respectively. <br />Failure to do so within 24 hours verbal notice by the City will result in the City undertaking this work with costs <br />subject to reimbursement by the Developer pursuant to Paragraph #11. <br />g• <br />Developer shall prepare by -laws, covenants, and restrictions to govern all of the Little Canada <br />Office Park plat. Specific provisions to be addressed in these documents include provisions for adequate, ongoing <br />maintenance of all Association improvements including the storm sewer system and pond; guarantees of access for <br />emergency vehicles; permission for the City and any of its contracted service providers to enter the property to <br />accommodate turn- around of vehicles and equipment, and acknowledgment of a prohibition of any future vehicular <br />access to Park Street. A copy of these documents shall be furnished to the City. <br />h. Developer shall grant a four -foot easement for access and maintenance of water service shut- <br />offs as required by the City's Director of Public Works. <br />Future occupants of the plat shall not be deemed to be third -party beneficiaries of this <br />II: UGisP \CORRESP \Kris' 2002 \I.0 Office Park Development Contract.doc <br />-5- <br />PAGE 12 <br />
