Hanson <br />TO: Mayor Fahey and Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: January 4, 2002 <br />RE: Vacation of Portion of Savage Lane and Rose Place Right -Of -Way <br />Sam Roberto is requesting that the City vacate a portion of the Savage Lane and Rose <br />Place right -of -way (see diagram attached) to facilitate the development of a single- family <br />house on property at the northwest corner of these streets. Mr. Roberto has submitted an <br />inadequate petition for the vacation (he will be attempting to obtain more signatures). <br />Without added signatures the vacation would have to be initiated by the Council. (A <br />vacation initiated by petition requires a 3 /5ths vote of the Council for approval, while a <br />vacation initiated by the Council requires a 4 /5ths vote.) <br />Please note from the diagram that Mr. Roberto is requesting the vacation of Rose Place <br />extending one lot to the east of his property. Council may want to consider whether this <br />is the appropriate distance (either a lesser distance or greater perhaps should be <br />considered). <br />For your information, Mr. Roberto also has made application for a setback variance for <br />the home he wishes to construct. The variance will be considered by the Planning <br />Commission at their January 10`1, meeting and will be before the Council on January 23rd. <br />If the Council wishes to consider the vacation, a public hearing should be called for <br />February 13, 2002. The Council should also determine the appropriate distance along <br />Rose Place to be considered for vacation so that the vacation can be properly noticed. <br />cc: Sam Roberto <br />
