TWENTY -THIRD RIDER TO AGREEMENT THIS AGREEMENT, made this J day of - / , 2002, by and between the BOARD OF WATER COMMISSIONERS OF THE CITY OF SAINT PAUL ( "Board "), and the CITY OF LITTLE CANADA, County of Ramsey, State of Minnesota, ( "City "), being the Twenty -Third Rider to that certain Agreement made by and between the Board and the City the 13th day ofJuly, 1966, and by this reference incorporated herein and made part hereof and with the same intent, purpose and effect as if said Agreement were set forth herein verbatim. WHEREAS, the Board now possesses fee simple title to a one - hundred (100) foot wide strip of land and a seventy (70) foot wide easement right -of -way east of and adjacent to the fee simple property, both located in the SW quarter of the SW quarter of Section 31, Township 30 North, Range 22 West, Ramsey County, Minnesota, south of Country Drive and west of Spruce Street in the City of Little Canada, collectively the "Premises "; and WHEREAS, the City desires to contract with the Ramsey - Washington Metro Watershed District (the "District ") so that the District's contractor may, on behalf of the City, enter upon certain portions of said Premises to thereupon install a 12 -inch drainage pipe to provide an overflow outlet for the Black Tern Pond located west of and adjacent to the Premises; and WHEREAS, the Board is willing to grant said permission to the City consistent with the requirements and safety of the works of the Board.
