Hanson <br />www.ci.litde- canada.mn.us <br />MEMORANDUM <br />TO: Mayor Fahey & Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: February 22, 2002 <br />RE: <br />Call for Public Hearing for Amendment to Zoning Code — Storm Shelters in Mobile <br />Home Parks as a Conditional Use <br />With the pending construction of the new storm shelter in North star Estates and recent interest by 3020 <br />Mobile Home Park to undertake a similar project, staff has come to the realization that our current zoning <br />code does not allow these structures due to the nonconforming status of these properties. Therefore, we <br />are recommending we allow for the construction of storm shelters in existing mobile home parks as a <br />conditional use. This concept would be similar to the manner in which we allow expansion of non- <br />conforming residential structures to improve their livability in Chapter 903 of the Zoning Code. <br />K Non - conforming, non - income producing, residential units may be expanded to <br />improve livability as a conditional use, provided that the non - conformity of the <br />structure will not be increased. <br />It is also consistent with our provisions that allow Mobile Home Parks to maintain operations as <br />nonconforming uses as defined in Chapter 903. <br />M. For the purposes of applying Subsections 903.010.D. and 903.010.G. to Mobile <br />Home Parks which are made non - conforming by land use zoning district, such <br />Mobile Home Parks shall be required to adhere to the following standards: <br />1. A mobile home in a non - conforming mobile home park may be moved, relocated, <br />or replaced on condition that the replacement mobile home shall comply with <br />Minnesota Statutes Chapter 327.20 Subdivision 1, paragraph (3), or the <br />following standards, whichever is more restrictive: <br />No manufactured home shall be located closer than three feet to the side <br />lot lines of a manufactured home park, if the abutting property is <br />unproved property, or closer than ten feet to a public street or alley. <br />Each individual site shall abut or face on a driveway or clear <br />unoccupied space of not less than 16 feet in width, which space shall <br />have unobstructed access to a public highway or alley. There shall be an <br />open space of at least ten feet between the sides of adjacent <br />manufactured homes including their attachments and at least three feet <br />
