Hanson <br />www.el.little- canada.mn.us <br />MEMORANDUM <br />TO: Mayor Fahey & Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: February 22, 2002 <br />RE: Amendment to Twin Lake Pines Development Agreement <br />Attached is Paragraph I5(g) from the above referenced Development Agreement. The purpose of this <br />provision was to prevent Outlot A (See diagram of plat attached) from going tax forfeit as an individual <br />parcel. Apparently, this was not set up in the manner we intended and to comply with our requirement at <br />this point would be a complicated process. <br />To rectify this problem, Mr. Pratt has proposed that Outlot A be Lot be owned by the owner of Lot 12, <br />Block 2. Staff feels this could work as long as the two properties are combined for tax purposes pursuant <br />to our zoning code, that all public easements over both lots be retained in their present form and intent, <br />that no access to the park land in Vadnais Heights can ever be granted by the owner of this property to <br />any other person or entity, and that these conditions be formalized by recorded deed restrictions on the <br />property. (I have also attached the ordinance provision governing combination of lots.) <br />Suggested wording for Paragraph 15(g) would be as follows: <br />Outlot A of the Twin Lake Pines plat shall be legally combined with Lot 12, Block 2 of the same <br />plat pursuant to the zoning and subdivision codes of the City of Little Canada. The purpose of <br />this requirement is to ensure that the newly combined parcel is to be treated as single parcel for <br />all purposes, including both zoning and property tax considerations. <br />As a condition of approval of said combination, Developer shall record the following covenants <br />against the newly created Lot 12 <br />1. Outlot A of the Twin Lakes Pines plat shall be legally combined with Lot 12, Block 2 of <br />the same plat pursuant to the zoning and subdivision codes of the City of Little Canada. <br />2. The owner of Lot 12, Block 2 hereby covenants and agrees never to grant any easement <br />or right of access for private or public use over said property that would provide any <br />means of access to park property located within the City of Vadnais Heights. <br />3. The owner of Lot 12, Block 2 of Twin Lake Pines shall reaffirm and acknowledge the <br />dedication of all easement existing over Outlot A and Lot 12 as originally dedicated as <br />part of the Twin Lake Pines plat. <br />Subject to any comments by the City Attorney, I would recommend adoption of this revision to the Twin <br />Lake Pines Development Agreement. <br />cc: Len Pratt <br />
