MINUTES
CITY COUNCIL
FEBRUARY 27, 2002
VARIANCE —
SAVAGE LANE/
ROSE LANE —
SAM ROBERTO
RESOLUTION NO. 2002 -2 -32 — TABLING ACTION ON THE NORM'S
TIRES' REQUEST FOR REZONING AND CONDITIONAL USE PERMIT
PENDING A RECOMMENDATION FROM THE PLANNING
COMMISSION
The foregoing resolution was duly seconded by Scalze
Ayes (5) LaValle, Scalze, Montour, Anderson, Fahey
Nays (0)_ Resolution declared adopted.
Fahey opened the continuation of Public Hearing to consider the request
of Sam Roberto for a setback variance property located on the northeast
corner of Savage Lane and Rose Lane so that he can construct a single -
family house and avoid poor soils on this property. It was noted that Mr.
Roberto is also requesting that the Council call for a vacation hearing for
vacation of a portion of the Savage Lane right- of=way as well as the north 10
feet of Rose Lane. It was noted that the Planning Commission has
recommended denial of the variance request as there was no hardship present
to warrant granting the variance. Fahey also noted that the Planning
Commission did not have the benefit of the Braun Intertec report relative to
soil conditions on the property.
Sam Roberto appeared before the Council and reviewed his plan for
constructing a residential house on this property. He indicated that he is
equesting a 10 -foot variance from the standard 30 -foot setback to allow house
placement on the most suitable portion of the property. The variance would be
'or the rear yard of the house as it lies in relation to Rose Lane. Roberto
eviewed his reasoning for the variance that would allow him to build on the
ost stable, dry earth that is available on this lot. There will be some soils
placement needed on the west portion of the lot, but a natural buffer on the
stern portion of the lot would be maintained from the adjacent wetland area
oberto then reviewed his reasons for avoiding construction on the eastern half
f the lot, pointing out that there are deep swamp deposits and a high ground
ter table. He noted that there would need to be substantial fill brought into
s portion of the property in order to support a house. Roberto then pointed
t that Braun Intertec performed soil borings in May of 2001 on this property
d verified that soil replacement is necessary. Roberto also referred to the
y Planner's report confirming the low /wet land on the eastern portion of the
indicating that that half of the lot appears to be unbuildable, and
ornmending approval of the variance. Roberto indicated that the Watershed
indicated there is no official wetland on the lot, but rather swamp deposits.
Watershed has also indicated the need for a buffer to the adjacent wetland
m
re
ea
R
0
wa
th1
ou
an
Cit
lot,
rec
has
The
area
