MINUTES
CITY COUNCIL,
FEBRUARY 27, 2002
yard, and he would like to see the house meet setback requirements. Ruche
noted that there are a lot of trees where Roberto is proposing to place the
house, and he would like to see the trees remain.
Fahey pointed out that the Buche property has a variance as it does not front on
an improved public street. Fahey indicated that, therefore, he feels compelled
to give Mr. Roberto some consideration for his variance request. Fahey stated
that he wanted someone more knowledgeable than him to interpret the soils
report and determine if it is feasible to build a house within the required
setbacks.
Scalze pointed out that the Braun report does not say pylings are necessary, but
says that soils will have to be replaced. Fahey stated that he was not sure and
wanted an interpretation of the Braun report.
Roberto indicated that the Braun report says that soils will need to be replaced
in the area that he is proposing to place his house. If the house is moved to the
east, the water table is quite high and soil replacement will no longer be a
Feasible option.
Fahey felt that if the cost of pylings and additional fill for placing the house
within required setbacks is cost prohibitive, then the lot becomes essentially
unbuildable without a variance.
Montour felt that the issue was determining at what point the amount of dollars
needed to construct a house on a lot with poor soils is too much for the
particular neighborhood.
Mr. Fahey introduced the following resolution and moved its adoption:
RESOLUTION NO. 2002 -2 -33 — TABLING ACTION ON THE ROBERTO
VARIANCE REQUEST PENDING AN OPINION FROM THE CITY
ENGINEER ON THE BRA UN INTERTEC REPORT RELATIVE TO THE
TYPE OF CORRECTIONS NECESSARY FOR CONSTRUCTION OFA
HOUSE WITHIN THE REQUIRED SETBACKS' AS WELL AS A COST
E,STJLLATE FOR THOSE CORRECTIONS, SUBJECT TO THE
APPLICANT SIGNING A 60 -DAY WAIVER AGREEMENT, AND
SUBJECT TO THE CITY ATTORNEY'S OPINION ON THE LSSUE OF
HARDSHIP
Ayes (5) resolution was duly seconded by LaValle.
y eS (5) Fahey, LaValle, Scalze, Montour, Anderson.
Nays (0). Resolution declared adopted,
