Hanson MEMORANDUM TO: Mayor Fahey & Members of the City Council FROM: Joel Hanson, City Administrator DATE: November 6, 2003 RE: Vacation of a Portion of Nadeau Road A 30 -foot road easement exists west of Condit Street for unimproved Nadeau Road. It was dedicated as part of the Southern Slope Addition (Burke Lane) that was approved back in 1940. Based on the thorough -fare plan we prepared for this area a few years ago, it does not appear this right -of -way is needed given a more efficient access exists between 2883 and 2901 Condit Street (See Planner's thorough -fare sketch and summary notes attached). Some key considerations of this vacation are as follows: • This vacation will not have any impact from a City utility standpoint. (See Memo from Public Works Director attached.) • The owner of 2883 Condit is the party who initiated this vacation request. They want to construct a garage and this vacation will resolve side yard setback issues. (Reduction from 30 feet to 10 feet.) • The right -of -way appears to have come from the Southern Slope Addition. If correct, the vacation of the right -of -way would accrue to the parcels on the south side of the right -of- way versus being split 50/50 between the south and north properties. However, the final determination rests with the County Land Records. • No parcels are being land locked as a result of this vacation. (As point of fact, the right - of -way that is the subject of this vacation did not provide for adequate access.) • To comply with the concept plan for this area, the owner of 2883 should dedicate the east 17 feet of his property to provide for the appropriate Condit Street right of way (we only have 33 feet at present versus the 50 required by our ordinance). This property owner should also dedicate the north 25 feet of the property for the future road connection. cc. Impacted Property Owners 4
