Hanson <br />MEMORANDUM <br />TO: Mayor Fahey & Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: November 6, 2003 <br />RE: Vacation of a Portion of Nadeau Road <br />A 30 -foot road easement exists west of Condit Street for unimproved Nadeau Road. It was <br />dedicated as part of the Southern Slope Addition (Burke Lane) that was approved back in 1940. <br />Based on the thorough -fare plan we prepared for this area a few years ago, it does not appear this <br />right -of -way is needed given a more efficient access exists between 2883 and 2901 Condit Street <br />(See Planner's thorough -fare sketch and summary notes attached). <br />Some key considerations of this vacation are as follows: <br />• This vacation will not have any impact from a City utility standpoint. (See Memo from <br />Public Works Director attached.) <br />• The owner of 2883 Condit is the party who initiated this vacation request. They want to <br />construct a garage and this vacation will resolve side yard setback issues. (Reduction <br />from 30 feet to 10 feet.) <br />• The right -of -way appears to have come from the Southern Slope Addition. If correct, the <br />vacation of the right -of -way would accrue to the parcels on the south side of the right -of- <br />way versus being split 50/50 between the south and north properties. However, the final <br />determination rests with the County Land Records. <br />• No parcels are being land locked as a result of this vacation. (As point of fact, the right - <br />of -way that is the subject of this vacation did not provide for adequate access.) <br />• To comply with the concept plan for this area, the owner of 2883 should dedicate the east <br />17 feet of his property to provide for the appropriate Condit Street right of way (we only <br />have 33 feet at present versus the 50 required by our ordinance). This property owner <br />should also dedicate the north 25 feet of the property for the future road connection. <br />cc. Impacted Property Owners <br />4 <br />
