ATTACHMENT 3 <br />TERMINATION OF EASEMENTS <br />RECITALS <br />WHEREAS, the City of Little Canada, a municipal corporation ( "City "), is the owner of <br />certain parcels of real property legally described on the attached Exhibit A ( "Property "); <br />WHEREAS, Tract A of the Property is subject to easements for utility and drainage <br />purposes as set forth in that certain Grant of Permanent Easement by and between Roy D. Guerin <br />and Anna M. Guerin, husband and wife (the "Guerins "), as Grantors and the City as Grantee, <br />dated February 26, 1991 and recorded on March 8, 1991 as Document No. 2587140 and re- <br />recorded on March 8, 1991 as Document No. 2587141, in the Office of the Ramsey County <br />Recorder; and <br />WHEREAS, Tract 13 of the Property is subject to easements for utility and drainage <br />purposes as set forth in that certain Grant of Permanent Easement by and between the Guerins as <br />Grantors and the City as Grantee, dated February 26, 1991 and recorded on March 8, 1991 as <br />Document No. 2587142 in the Office of the Ramsey County Recorder; and <br />WHEREAS, the City has determined that no utilities or drainage systems currently exist <br />or will be constructed within the easement areas on the Property and the City desires to release <br />the Property from the above described easements in order to clear title to the Property. <br />TERMINATION <br />1. The easements set forth in the Grant of Permanent Easement dated February 26, <br />1991 and recorded on March 8, 1991 as Document No. 2587140 and re- recorded on March 8, <br />1991 as Document No. 2587141 are hereby terminated. <br />2. The easements set forth in the Grant of Permanent Easement dated February 26, <br />1991 and recorded on March 8, 1991 as Document No. 2587142 are hereby terminated. <br />IN WITNESS WHEREOF, the City has executed this Termination effective as of <br />, 2003. <br />1589286v1 1 <br />5 <br />
