Hanson <br />Attached is Change Order #1 for the Market Place Drive project. Staff has been reviewing this issue with <br />the City Engineer and the Market Place Shopping Center owners. Regardless of the outcome of that <br />discussion, we need to pay Park Construction for removal and disposal of this material. Therefore, I <br />recommend approval of Change Order #1 as presented. Payment on this Change Order will be made <br />when we process the next application for payment to the contractor. <br />Regarding the material that was removed, I have learned the following: <br />• Material consisted of rubble from a foundation, tree stumps, and organic matter (topsoil). <br />▪ It existed only under the new Market Place Drive right -of -way that originated from the <br />Delonais property. There was no material of this nature under the former Burger King <br />and Pizza Hut parking lots that became part of the new street. This indicates that it <br />originated from the demolition work on the Delonais property. <br />• Bob Grootwassink has supplied with me invoices documenting the debris that was hauled <br />from the site. <br />• Our development agreements with Market Place clearly delineated the future Market <br />Place Drive Street location and the Developer's obligation to convey the needed right -of- <br />way if they were in control of the property. <br />I am still awaiting additional documentation from our inspector before I prepare a final recommendation <br />on this matter. I will report back on this topic at a later date relative to my opinion as to cost recovery <br />from Market Place Shopping Center. <br />cc: Lee Elfering, City Engineer <br />
