EXHIBIT C <br />WAIVER OF RIGHT TO APPEAL FROM SPECIAL ASSESSMENT <br />OF LITTLE CANADA IMPROVEMENT PROJECT 2000 -16 <br />The undersigned, Rob Carlson of Rob Carlson Builders, Inc., is the owner of the following - <br />described property located in the City of Little Canada, County of Ramsey, State of Minnesota, <br />which is legally described as follows: <br />Lot 1, Block 1, HAMEL ESTATES <br />subject to easements of record. <br />The undersigned, his successors, representatives, and assigns understand and agree that the <br />sum of $5,309.50, a portion of the cost of Little Canada Improvement Project 2000 -16, relating to the <br />construction of streets, appurtenant drainage system, and water main within the Twin Lake area, as <br />described in the City Engineer's Feasibility Report, dated December, 2000 is to be assessed against <br />the above - described property. The undersigned further understands and agrees that the assessment <br />shall be made pursuant to Minnesota Statutes Chapter 429, and shall be certified for payment to the <br />Department of Taxation for Ramsey County. <br />The undersigned understands and acknowledges that the special assessment of $5,309.50 <br />could be challenged and that a court would independently review the propriety of the assessment and <br />would uphold the assessment only upon a finding that each of the following have been established: <br />(1) The property received a special benefit, in other words, a benefit not generally received by other <br />properties which were not assessed; (2) The special benefit, or increase in the market value of the <br />property as a result of the improvement, is equal to or greater than $5,309.50; and (3) The special <br />assessment levied was imposed equally on similar properties and did not unfairly discriminate against <br />the undersigned. <br />
