ISSUES ANALYSIS <br />Accessory Building Area Requirements. According to Section 903.020.D.5 of the <br />zoning ordinance, each single family lot within the City is eligible for the following <br />accessory structures: <br />1. One garage structure, whether attached or detached. <br />2. One recreational accessory building of no more than 160 square feet, and with <br />no horizontal dimension or more than 16 feet in length or width as a permitted <br />use. For the purposes of this ordinance a recreational accessory structure shall <br />be designed for temporary and seasonal occupancy, but shall not include <br />permanent storage of materials. Examples of such structures shall include <br />gazebos, detached porches, or similar buildings. <br />3. One accessory shed. <br />To be specifically noted is that the maximum dimension requirements of for recreational <br />accessory buildings (160 square feet and a maximum horizontal dimension of 16 feet) <br />were purposely conceived to discourage future use or re -use of such buildings as <br />detached garages. <br />In addition to the preceding requirements, Section 903.020.D.5 of the ordinance states <br />that in no instance shall the total floor area of a garage and an accessory building <br />exceed 1,500 square feet in size. <br />As previously indicated, a detached accessory building (garage) measuring 1,152 <br />square feet in size and a storage shed measuring 120 square feet in size presently exist <br />on the property. Approval of the proposed recreational accessory building would result <br />in a total of 1,752 square feet of accessory storage space on the property. <br />Variance Evaluation Criteria. According to Section 922.010 of the ordinance, a variance <br />from the terms of the ordinance shall not be granted unless it can be demonstrated that: <br />a. Special conditions and circumstances exist which are peculiar to the land, <br />structure, or building involved. <br />(1) Special conditions may include exceptional topographic or water <br />conditions or, in the case of an existing lot or parcel of record, <br />narrowness, insufficient area or shape of the property. <br />(2) Special conditions and circurnstances may not be primarily economic <br />in nature. <br />2 <br />
