Aug 21 03 12:07p <br />.e. <br />CD <br />August 20, 2003 <br />City of Little Canada <br />Joel Hanson, Administrator <br />515 Little Canada Road <br />Little Canada, MN 55117 <br />In Re: The Preserve <br />Dear Joel, <br />DAYSPRING <br />DEVELOPMENT, LLC <br />p.2 <br />After having studied the proposal by the City for revising the Preserve Plat to eliminate Preserve <br />Trail and three lots, we have concluded that the proposed revisions do not present adequate <br />incentives to justify what is effectively starting over in the process. It was especially <br />troublesome that the proposal offered by the City required Dayspring Development to apply for <br />a variance for cul -de -sac length — with no guarantee that the variance would be approved. <br />We maintained early in the process that a single loaded cul -de -sac with a length in excess of the <br />ordinance required 500 feet would be a better design solution than the addition of the <br />intermediate street to comply with the ordinance requirement. The City Council addressed the <br />idea in 2002 and, on a three to two decision, voted not to have a long cul-de -sac. We have also <br />maintained that a 20 foot front yard setback (as allowed in the shoreland overlay ordinance) on a <br />single loaded road is a better design solution than the standard ordinance requirement of 30 feet, <br />that issue was also declined. <br />It has been a long and arduous process to get to this point in the application for final plat <br />approval. Accepting the City's proposal is not only financially unviable but also puts at risk <br />everything we have done to date. For these reasons we are moving forward with our plat as <br />proposed, submitted and amended.
