must be set within one year of the recording of the plat. All plat monuments originally set which are removed or <br />disturbed during development shall be replaced after the completion of construction activities or no later than <br />August 1, 2004. All costs incurred with regard to monument placement, verification and replacement shall be borne <br />by Developers. <br />d. Developers, or their agents or assigns, shall keep the public streets clear of any soil, earth <br />or debris resulting from construction work undertaken by Developers or their agents or assigns respectively. <br />Materials must be promptly removed and in no event shall they be present more than 24 hours after placement. <br />Failure to comply with this provision will result in the City undertaking this work with costs to be reimbursed by <br />Developers pursuant to Paragraph #11. <br />e. Developers are responsible for making any arrangements with property owners benefited by <br />the improvements constructed to serve the Inman Addition Plat but who are not party to this agreement. Evidence <br />of any financial relationship with impacted property owners must be provided to and approved by the City before <br />work on any improvements commences. Should no such arrangements occur prior to construction of any <br />improvements, City will charge affected property owners appropriate connection charges commensurate with the <br />value of said improvements according to City policy at the time said property owners make use of the public <br />improvements. No payment will be made to Developers as a result of the collection of these charges. City will also <br />reimburse Developers for the cost of service connections to Lot 6, Block 1 and Lot 2, Block 2 of Greenbrier Woods, <br />County of Ramsey, State of Minnesota in the event no arrangement exists between Developers and affected property <br />owners to minimize future disruptions to Allen Avenue. <br />f. Developers agree that no further subdivision of their property will be allowed unless it is done <br />in conjunction with the adjoining property (currently owned by the owner of 791 LaBore Road) as depicted on <br />Exhibit C attached hereto. Furthermore, should the owner(s) of the adjoining property wish to subdivide their <br />property, Developers shall cooperate fully with said future subdivision including subdividing their property at the <br />H:Uoeif \Correspondence\Joel 2003 \Inman Development Contract.doc <br />-5- <br />
