MINUTES <br />CITY COUNCIL <br />MAY N, 2003 <br />PERSONNEL <br />POLICY <br />AMENDMENT - <br />E1.EMPT <br />EMPLOYEES <br />The City Administrator indicated that this was a staff recommendation, <br />and the concern was with the aesthetics of a dry pond. The Administrator <br />recommended that if the decision is to allow a dry pond, that the <br />homeowners association documents be drafted acknowledging their <br />ownership of the pond as well as maintenance responsibilities. <br />Anderson pointed out that the townhome association would own the pond <br />and would be responsible for it, but the residents of the senior building <br />will have a view of the pond. Blesener suggested that the townhome <br />association would have the ability to convert the pond to a wet pond, and <br />if the residents of the senior building felt strongly about it, they could <br />contribute toward the cost of maintaining a wet pond. <br />Fahey agreed that if the City wanted water maintained in the pond, this <br />was the time to require it. LaValle felt that it was up to the townhome <br />associations whether the pond was wet or dry. The City Administrator <br />suggested that the City could require the developer to escrow funds for a <br />period of five years to allow for conversion of the pond to a wet pond. In <br />that way, if the matter becomes an issue within that time frame, the pond <br />could be converted to a wet pond. Fahey stated that he liked this idea as it <br />kept options open. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2003 -5 -115 — TABLING ACTION ON THE <br />PRELIMINARY AND FINAL PLAT, DEVELOPMENT STAGE PUD, <br />ARCHITECTURAL REVIEW, AND PROPERTY DIVISION FOR <br />THE VILLAGE AT LITTLE C,4N,4DA UNTIL THE JUNE 24, 2003 <br />COUNCIL MEETING <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Blesener, LaValle, Montour, Fahey, Anderson. <br />Nays (0). Resolution declared adopted. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2003-5-116 — AMENDING THE PERSONNEL <br />POLICY CHANGING ALL REFERENCES TO "DEPARTMENT <br />HEADS" TO "EXEMPT EMPLOYEES" AS RECOMMENDED 13I' <br />THE CITY ADMINISTRATOR <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5) Fahey, Blesener, Montour, Anderson, LaValle. <br />Nays (0). Resolution declared adopted. <br />
