MINUTES <br />CITY COUNCIL <br />MAY 23, 2007 <br />PUD PERMIT - <br />2905 <br />COUNTRY <br />DRIVE - <br />TEMO <br />SUNROOMS <br />CONDITIONAL USE PERMIT FOR A COMPREHENSIVE SIGN <br />PLAN SUBJECT TO COMPLIANCE WITH THE <br />RECOMMENDATIONS OF THE CITY PLANNER AS OUTLINED IN <br />HIS REPORT DATED APRIL 9, 2007 <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />Mayor Blesener opened the Public Hearing to consider the application <br />of Temo Sumooms & Exteriors, 2905 Country Drive, for a Planned Unit <br />Development Permit to construct a display gazebo and a second <br />accessory garage structure. It was noted that the City Planner and the <br />Planning Commission recommended against the PUD Permit based on <br />the findings of fact as outlined in the City Planner's report dated May 4, <br />2007. <br />The City Planner noted that the Temo Sunrooms property is zoned PUD; <br />and as part of the redevelopment of this property a number of years ago, <br />the goal was for an office/showroom or office/warehouse use for this area. <br />The Planner indicated that the property owner is asking to build a second <br />storage garage at the back of the City. This additional garage would take <br />up three to four parking spaces. The property owner is also asking for to <br />display a gazebo in the front yard of the property along Country Drive. <br />This gazebo would also take up designated parking spaces. The property <br />owner has indicated that there is no inside display space for the gazebo. <br />The Planner noted that the applicant also indicated that the gazebo would <br />be utilized by employees for breaks and lunches, in addition to it being <br />used as a sales display. The Planner reported that the Planning <br />Commission recommended denial of the PUD Permit amendment given <br />that the intent of the district is for office-showroom and office-warehouse <br />use, rather than retail. <br />The City Administrator pointed out that at the Planning Commission <br />meeting there was discussion about the garage on the Temo site as well as <br />the garages on the property to the north. The Administrator noted that <br />these are not garages, but rather trash enclosures. The Administrator <br />noted that a building permit was issued in 2002 for the Temo site to <br />enclose the trash enclosure. The Administrator reported that currently the <br />dumpster for the Temo property is being stored outside, and this is a code <br />violation. <br />Bob Maietta, Temo Sunrooms, reported that he recently purchased the <br />property and has made a substantial investment in it. Maietta indicated <br />that he sells prefabricated sumoom additions and is trying to build his <br />9 <br />
