MINUTES <br />PLANNING COMMISSION <br />JUNE 12, 2003 <br />It was noted that the City Planner recommends that the City retain the <br />right to relocate Mr. Stafki's sales location if traffic flow becomes a <br />problem. <br />Barraclough recommended approval of the CUP for outdoor sales of <br />produce in the Market Place Shopping Center parking lot as requested by <br />Mr. Ed Stafki subject to compliance with the recommendations of the City <br />Planner. <br />Motion seconded by Knudsen. <br />Motion carried 7 — 0. <br />CUP FOR The Commission reviewed the application For a Conditional Use Permit <br />FIREWORKS to allow the sale of fireworks from a tent in the Market Place Shopping <br />SALES — Center parking lot as requested by FW Shreveport. The Planner noted <br />2900 RICE- that the applicant was not at the meeting this evening as they are from <br />FW SHREVEPORT out -of- state. The Deputy Clerk reported that the applicant has indicated <br />that they are in agreement with all the recommendations of the City <br />Planner and the Fire Chief. <br />Duray questioned the safety of selling fireworks from a tent as well as the <br />security that would be provided during the night hours. <br />The City Planner indicated that the Fire Chief has reviewed the application <br />from a safety standpoint and is recommending approval subject to certain <br />conditions being met. The applicant is agreeable to those conditions. The <br />Planner also indicated that the applicant has indicated that there will be <br />24-hour security provided for this tent sales location. <br />Duray suggested that fireworks sales may be safer from a building versus <br />a tent. He also indicated that he had questions relative to the overnight <br />security that would be provided. Duray suggested tabling action on the <br />CUP until the applicant can be present to answer questions. <br />The Planner noted that the applicant is asking to conduct Fireworks sales <br />from June 25th through the July 4"' weekend. Given that the Planning <br />Commission does not meet again until Judy 10'x', the Planner suggested <br />that rather than tabling, the Commission act on the matter and allow it to <br />go forward to the City Council. <br />Duray asked if fireworks sales from a building required a CUP. The <br />Planner indicated that the CUP is required given the outdoor sales. <br />_7 <br />
