I- Ianson <br />Attached is a proposed ordinance that would establish massage therapy as a principal use business <br />with the City of Little Canada. (Staff has attached the pertinent sections of our codes that deal with <br />Massage and Adult uses for your reference.) As noted by the City Attorney, this ordinance <br />distinguishes massage therapy businesses from massage parlors. It should be noted that we are <br />revising this draft to included the following: <br />• Clarifying Definitions to distinguish Massage Therapy from Massage Parlor. <br />• Limiting the number of Massage Therapy — Principal Use Licenses to one (1). <br />We also need to address some zoning issues related to this process. Specifically, staff is <br />recommending the property owner do the following related to this request: <br />• Apply to rezone the parcel in question from B -W to B -3. <br />The current parcel does not meet B -W requirements for lot width. It will meet <br />B -3 requirements. Also, Joe's Sporting Goods is zoned B -3. Therefore, this <br />lot would be a better fit as a B -3 parcel. <br />• Apply to establish Massage Therapy as a conditional use in the B -3 zoning district. <br />One item of note is Mr. McCann has requested four therapist licenses for his establishment. The draft <br />only provides for two. The Council will have to discuss the implications of this issue. <br />In conjunction with the adoption of this ordinance, the City Council will need to establish license fees <br />for massage therapy businesses as principal uses and massage therapists working within these <br />businesses. Currently the license fees for massage therapy as accessory uses are $100 annually for <br />the business and $75 annually for the therapist.
