Summary and Recommendation <br />As noted, the zoning ordinance allows consideration of a variance where a physical <br />condition of the property creates a hardship in putting the property to reasonable use. <br />For the Gervais Beach project, reasonable use includes handicapped access to the <br />facilities such as the fishing pier. Without the variance, the pathway would result in a <br />much more significant grading impact. As such, planning staff recommends approval of <br />the setback variance for the pathway as shown on the proposed plans.
