Summary and Recommendation
As noted, the zoning ordinance allows consideration of a variance where a physical
condition of the property creates a hardship in putting the property to reasonable use.
For the Gervais Beach project, reasonable use includes handicapped access to the
facilities such as the fishing pier. Without the variance, the pathway would result in a
much more significant grading impact. As such, planning staff recommends approval of
the setback variance for the pathway as shown on the proposed plans. To protect the
intent of the Shoreland Ordinance, planning staff would recommend that a condition of
variance approval should be a requirement that the remainder of the park and within
the 25 foot zone be left in a natural state, or restored with natural plant materials.
pc: Kathy Glanzer
Steve Westerhaus
Lee Elfering
Greg Schroeder
Larry Holmberg, Ramsey County Parks Dept., 2015 N.
