Hanson <br />Based on Council direction, I have prepared a sketch of the Rose Place right-of-way near the intersection of <br />Savage Lane. As indicated, this right -of -way is 60 feet wide with our sanitary sewer line located near the <br />middle. Mr. Buche's driveway is 20 feet wide and is located in our right -of -way only about 6.5 feet from the <br />south property line. The south right -of -way property line along the Anderson property is actually located on a <br />steep grade that runs parallel to our right -of -way. <br />I do not believe the likelihood that Rose Place would be constructed through this area in the future. However, if <br />the City of Little Canada vacated the north 10 feet of right -of -way from Rose Place, we would end up placing <br />the new street closer to the south property line. By placing the street closer to the steep grade (hill) located <br />along the south right -of -way line, the cost to construct this street would increase. In addition, future snow <br />storage could also impacted. <br />Staff does not recommend we vacate right -of -way on top of the hill to Morrison. That would restrict our ability <br />to place a cul -de -sac or even a modified hammer handle on top of the hill when that section of Rose Place is <br />reconstructed. <br />As shown on the sketch, Mr. Buche's driveway is located about 6.5 feet from the Mr. Anderson's property. Mr. <br />Buche maintains his driveway and plows his snow along both the north and south sides of his driveway. If 5 <br />feet were to be vacated along each side of the Rose Place right -of -way there would only be 1.5 feet of room to <br />store snow along the south side of his driveway. This could result in a potential property owner complaint by <br />Mr. Anderson (or a future owner) that the Buche's are dumping snow on someone else's property. The solution <br />would then be to either 1) move this driveway north to provide enough snow storage area, or 2) as part of the 5 <br />foot vacation, Mr. Anderson would grant a 5 foot snow storage easement along that property line. <br />Based on the above, if the City of Little Canada wishes to vacate 10 feet of Rose Place right -of -way in this <br />area, staff would recommend vacating 5 feet on each side of the Rose Place right -of -way, from Savage <br />Lane to Mr. Buche's east property line, subject to Mr. Anderson granting Mr. Buche a 5 foot easement <br />along his property for snow storage. <br />H: \GregS \Correspondence \Greg 5 2003 \Rose Place Right- of- Waydoc <br />
