Hanson <br />TO: Mayor Fahey and Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: January 17, 2003 <br />RE: Vacation of Excess MN DOT Right -Of -Way and a Portion of Rose Place <br />Sam Roberto has applied for the vacation of excess MN DOT right -of -way we recently obtained <br />(excess of Savage Lane) as well as the northerly 10 feet of Rose Place. Key information for each <br />vacation is as follows: <br />Excess Savage Lane <br />Staff would recommend the vacation of the excess right -of -way as depicted on <br />Diagram A attached. We will need to retain utility easements over this land given the <br />existence of a hydrant at the southwest corner of this property and to protect our <br />sanitary sewer line which runs along the west side of this property. (See Diagrams B <br />and C attached.) In discussing this with MN DOT staff, they did not convey fee <br />interest to us. Therefore, no compensation should be payable from Mr. Roberto to the <br />City for this property as underlying fee ownership comes from the Roberto property. <br />Rose Place <br />Mr. Roberto requested we vacate the northerly 10 feet of Rose Place. When the <br />Council considered the vacation request, a variance was granted of between 10 to 15 <br />feet subject to the outcome of the vacation of Rose Place (see minutes of 3/13/02 <br />attached). Derek Anderson had requested that 5 feet come off of each side of Rose <br />Place. My recommendation would be that the Council should decide between these <br />two options based on the testimony of the affected property owners. In either case, I <br />would recommend that we retain utility and drainage easements over the property to <br />be vacated. <br />
